By accessing or using the website at sananselmoconcrete.com (the "Site"), or by engaging San Anselmo Concrete ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use this Site or engage our services. These terms apply to all visitors, customers, and any other users of the Site or our services.
San Anselmo Concrete is a licensed concrete contractor based in San Anselmo, CA. We provide residential and commercial concrete services including, but not limited to: driveway installation and replacement, patio construction, foundation work, retaining walls, concrete flatwork, decorative and stamped concrete, and related services. All services are performed subject to a separate written agreement between the customer and San Anselmo Concrete.
The content on this Site is provided for general informational purposes only and does not constitute a binding offer to perform services. Nothing on this Site creates a contractor-customer relationship without a signed written agreement.
All estimates provided by San Anselmo Concrete are based on information available at the time of the estimate, including a site visit where applicable. Estimates are valid for 30 days from the date issued unless otherwise noted in writing. Final pricing is subject to change if the scope of work changes, unforeseen site conditions are discovered, or material costs change materially between the estimate date and the project start date.
An estimate is not a contract. Work will not begin until a written agreement or work order is signed by both parties. Verbal agreements are not binding on San Anselmo Concrete.
Project start dates are scheduled based on crew availability and permit timelines. We make reasonable efforts to meet scheduled dates, but delays caused by weather, permit processing, supply chain issues, or other factors outside our control are not grounds for claims against San Anselmo Concrete.
If a customer cancels a scheduled project after a written agreement has been signed, the customer may be responsible for costs already incurred, including permit fees, material orders, or equipment reservations, as specified in the written agreement. Cancellation terms will be set out in the project-specific agreement.
Payment terms are specified in each written project agreement. Unless otherwise agreed in writing, payment is structured as a deposit due at contract signing, progress payments at defined milestones, and a final payment upon substantial completion of the work. Final payment is due upon project completion and before the customer occupies or uses the completed surface.
Invoices not paid within the timeframe specified in the written agreement may be subject to a late fee as set forth in that agreement. San Anselmo Concrete reserves the right to stop work if payments are not received on schedule.
The customer is responsible for: (a) providing clear access to the work area; (b) relocating vehicles, personal property, and obstructions before the crew arrives; (c) disclosing known underground utilities, irrigation lines, or other hazards; and (d) complying with any homeowners association rules or local ordinances that may affect the project. San Anselmo Concrete is not responsible for damage to undisclosed underground utilities or obstructions.
Where required by local ordinance, San Anselmo Concrete will apply for and obtain necessary building permits before work begins. Permit fees are typically included in the project estimate or listed as a separate line item. Work will not begin on permitted projects until the permit has been issued. Customers must not request that we skip the permit process; doing so releases us from any obligation to perform or complete the project.
San Anselmo Concrete warrants that all work will be performed in a workmanlike manner consistent with industry standards for residential concrete construction in CA. Specific warranty terms, including duration and coverage, are set out in the written project agreement. This warranty does not cover:
Concrete is a natural material that may develop hairline cracks as it cures and settles. Minor surface cracking that does not affect structural integrity is not a defect and is not covered under warranty.
To the fullest extent permitted by applicable law, San Anselmo Concrete's total liability for any claim arising out of or related to these terms, our services, or your use of this Site will not exceed the total amount paid by the customer for the specific project giving rise to the claim.
We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of profits, or damage to property not caused directly by our work, even if we have been advised of the possibility of such damages.
Except as expressly stated in a written project agreement, the Site and all information on it are provided "as is" without warranties of any kind, express or implied. We make no warranty that the Site will be uninterrupted or error-free, or that any specific outcome will result from using the information on the Site.
If a dispute arises between you and San Anselmo Concrete regarding our services or these terms, we encourage you to contact us directly first at projects@sananselmoconcrete.com to try to resolve the issue informally. Most concerns can be addressed quickly with a direct conversation.
If the dispute cannot be resolved informally, both parties agree to attempt non-binding mediation before pursuing any other legal remedy. Mediation will be conducted in San Anselmo, CA by a mutually agreed-upon mediator. If mediation fails, either party may pursue their legal remedies as permitted by applicable law.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of CA, without regard to its conflict-of-law principles. Any legal action arising out of or related to these terms or our services will be brought in the appropriate courts located in CA.
All content on this Site, including text, images, logos, and graphics, is the property of San Anselmo Concrete or its licensors and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or use any content from this Site without our prior written permission.
